By enrolling in Madison Gardens Apt. Corp. ("Madison Gardens," "we," "us," or "our") SMS, email, and voice alert services, you agree to these Terms of Service. If you do not agree to these terms, please do not opt in to our messaging services.

2. Service Description

Madison Gardens provides optional SMS text messages, emails, and automated voice alerts to residents who opt in. These communications may include:

• Maintenance work notifications
• Service interruptions and repairs
• Safety notices and emergency alerts
• Building updates and announcements
• Other time-sensitive information relevant to residents

3. Opt-In and Consent

By signing the Resident Alerts Consent Form or otherwise providing your contact information for this service, you expressly consent to receive automated text messages, emails, and voice calls from Madison Gardens. You confirm that the phone number and email address provided belong to you.

4. Message Frequency

Message frequency varies but typically does not exceed 2 alerts per month. However, frequency may increase during emergencies or periods requiring urgent communication.

5. Message and Data Rates

Message and data rates may apply. Standard text messaging rates charged by your mobile carrier will apply to any SMS messages you receive from us. Madison Gardens is not responsible for any charges incurred from your mobile carrier.

6. Opt-Out Rights

You may opt out of receiving messages at any time by:

• Replying STOP to any text message
• Replying HELP to receive assistance
• Emailing the board at board@madisongardens408.com

After opting out, you will receive one final confirmation message. You may opt back in at any time by signing a new consent form.

7. Privacy

Your personal information will be handled in accordance with our Privacy Policy. We will not sell or share your contact information with third parties for marketing purposes.

8. Limitation of Liability

Madison Gardens makes reasonable efforts to provide timely and accurate information through our alert service. However, we do not guarantee the timeliness, accuracy, or completeness of any information transmitted. We are not liable for:

• Delays in message delivery
• Messages not received due to technical issues
• Actions taken or not taken based on alert content
• Charges from your mobile carrier

9. Service Availability

This alert service is provided on an "as is" basis. Madison Gardens reserves the right to modify, suspend, or discontinue the service at any time without notice.

10. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on our website with an updated "Last Updated" date. Your continued use of the service after changes constitutes acceptance of the modified terms.
